Article 18, paragraph 1, point c) of the Law on Public Roads ("Official Gazette of the Republic of Srpska", number: 89/13) stipulates that the activity of the Public Enterprise "Autoputevi Republika Srpska" d.o.o. Banja Luka, among other things, provides design and other documentation for the construction, reconstruction, or rehabilitation of highways, expressways, road facilities, and toll collection facilities.

The Spatial Plan of the Republika Srpska until 2025, which was adopted at the session of the National Assembly of the Republika Srpska on 18 February 2007 ("Official Gazette of the Republika Srpska", No. 15/2015), provides that the most significant planned transport infrastructure projects on the territory of the Republika Srpska during the plan period are, among others, the Vukosavlje (Modriča)-Brčko highway.

Given that no activities have been conducted regarding the construction of the Vukosavlje (Modriča)-Brčko highway section (except that the said section is part of the spatial plan of the Republika Srpska), and that there is no project and planning documentation for its construction, including a Feasibility Study, an Environmental Impact Study and other technical documentation, there is a need to initiate activities to obtain the appropriate level of study, planning and project documentation for the said route.

As part of the implementation of the project to build a highway network in the Republika Srpska, and to build the Vukosavlje - Brčko highway section, as part of the Vukosavlje (Modriča) - Brčko - Bijeljina - border with the Republic of Serbia highway, the Public Enterprise "Autoputevi Republike Srpske" Limited Liability Company Banja Luka has completed preliminary talks with "CHINA JIANGXI CORPORATION FOR INTERNATIONAL ECONOMIC & TECHNICAL COOPERATION" from the People's Republic of China and agreed on the positions for signing the Memorandum of Understanding.

The Memorandum of Understanding implies joint participation in the development and implementation of the Vukosavlje–Brčko motorway construction project — the aforementioned Memorandum of Understanding is attached to this Information document. The Memorandum defines preliminary activities that could lead to specific agreements for the implementation of the construction of the aforementioned motorway section. The said Memorandum is non-binding in nature and contains solely an understanding based on which the parties may initiate projects, and it does not oblige any of the parties to commence the projects referred to in the Memorandum. Any obligations shall be determined by the terms of a mutually acceptable Infrastructure Works Agreement or another agreement, and as such, it represents the basis for initiating activities related to the implementation of the Vukosavlje–Brčko motorway construction project.

The aforementioned Memorandum of Understanding was signed on August 18, 2017, between the PE "Autoputevi Republika Srpska" d.o.o. Banja Luka and "CHINA JIANGXI CORPORATION FOR INTERNATIONAL ECONOMIC & TECHNICAL COOPERATION" of the People's Republic of China.
